Terms of Service

These terms apply to the website at https://www.prostarplanet.com and to the design, development, hosting and maintenance services provided by Pro Star Website Design ("we", "us"). Where you have signed a separate written agreement or accepted a written quote, that document governs and these terms fill the gaps.

Using this website

You may browse this site and contact us through it. You may not attempt to gain unauthorised access to it, interfere with its operation, scrape it at a rate that degrades service for others, or use it to send unlawful or abusive material.

Quotes, work and payment

• Work begins when a quote is accepted in writing and any agreed deposit is paid.
• A quote covers the scope described in it. Additional work is quoted separately before it starts - we do not add charges you have not agreed to.
• Invoices are due on the terms stated on the invoice. Hosting and maintenance are billed in advance for the period they cover.
• Persistently unpaid accounts may have services suspended after written notice.

Your material

You keep ownership of the text, images, logos and other material you supply. By supplying it you confirm you have the right to use it and you permit us to use it for the purpose of building and running your site. You are responsible for the accuracy and legality of what you provide.

What we produce

On full payment, you own the finished website content and design produced specifically for you. We retain ownership of our own underlying tools, frameworks, libraries and administrative systems, which are licensed to you for use with your site and are not transferred. Third-party components remain under their own licences.

Hosting

• We aim for continuous availability but do not guarantee uninterrupted service. Maintenance, provider outages and events beyond our control can cause downtime.
• We take routine backups as part of the hosting service. You remain responsible for keeping your own copies of anything you cannot afford to lose.
• Hosted sites must not be used for unlawful material, spam, malware, or anything that endangers the server or other customers. We may suspend a site that does, with notice where circumstances allow.

Third-party services

Sites we build often connect to services we do not control - payment processors, mapping, video, analytics, social platforms and similar. Those services have their own terms and their own availability, and we are not responsible for changes they make or outages they experience.

Cancellation

You may cancel an ongoing hosting or maintenance service with 30 days' written notice; fees already paid for the current period are not refunded. Project work already performed is payable. We will co-operate reasonably in transferring your site to another provider.

Warranties and liability

We provide our services with reasonable skill and care. Beyond that, and to the extent the law allows, services are provided "as is" without further warranty. Our total liability arising from our services is limited to the amount you paid us for the service in question in the twelve months before the claim. We are not liable for indirect or consequential loss, including lost profits or lost data.

Nothing here limits liability that cannot be limited by law.

Changes to these terms

We may update these terms; the date at the top shows when. Changes affecting an ongoing service will be sent to clients by email before they take effect.

Governing law

These terms are governed by the laws of the State of Alabama, United States, and the courts of that state have jurisdiction.
